Authority Absolute and Authority Relative


In the Civil Procedure Code there are two kinds of authority, namely:

1. Absolute Authority (Absolute Competentie) -> about the division of power


between justice agencies, seen from the court regarding the kinds
awarding powers u / judge (attributie van rechtsmacht)

2. The authority relative (Relative Competentie) -> set the power-sharing
adjudicate between the court similar to that, depending on the defendant's residence ->
Ps. 118 HIR

-> Principle "Actor sequitur forum Rei" -> which is authorized PN residence of the defendant.
